2009 OFFICIAL CONTEST RULES

1. Entry: NO PURCHASE NECESSARY. PURCHASE DOES NOT IMPROVE CHANCE OF WINNING. CHANCE OF WINNING DEPENDS ON TOTAL NUMBER OF ELIGIBLE ENTRIES. Enter by completing all necessary information requested at www.daytonahotels.com.
   Only one entry allowed per day. Contest begins July 7, 2009 at 12:01 am EST and ends on August 15, 2009 at 11:59 pm EST. Automated/robotic entries will be disqualified.
2. Eligibility: ONLY U.S. AND CANADIAN RESIDENTS WHO ARE 18 YEARS OF AGE OR OLDER ARE ELIGIBLE TO ENTER THIS CONTEST. Employees of Surfside Hotel, Bermuda House, or Ocean Waters Management, LLC, their respective parents, subsidiaries, or affiliates, and members of their immediate family may not participate.
3. Winner Selection: Prize winners will be selected in a random daily drawing from among all eligible entries from July 7, 2009 at 12:01 am EST and ends on August 15, 2009 at 11:59 pm EST. The prize winners will be notified by e-mail, at the same e-mail address with which the entrants entered the contest. All winners’ names will be posted at www.daytonahotels.com/sweepstakes/winners.php on or before August 20, 2009. The prizes must be accepted “as is” – no substitution or transfer of a prize is permitted and no cash equivalent will be awarded. If a prize winner cannot be contacted or is disqualified, Ocean Waters Management, LLC reserves the right to determine an alternate prize winner.
4. Prizes: Daily prize consists of one free night stay at an Ocean Waters property; the exact selections of property to at all times remain the sole decision of Ocean Waters Management, LLC. One (1) room night will be given away each day for the period of sweepstakes – forty (40) prizes in all. Winners will be provided a gift certificate that is valid for one (1) room night valued up to $99.00. In order for a winner to properly tender the gift certificate, winner MUST follow the room reservation instructions included with the certificate. Total value for all prizes offered is $3,960.00.
5. Refer-A-Friend: In conjunction with the daily room drawing, Ocean Waters Management, LLC. shall award one prize, a $250.00 general use gift card, to the single entrant who “forwards” the sweepstakes webpage to the greatest number of valid email addresses. Winner notified within 24 hours of f August 15, 2009 at 11:59 pm EST.
6. General Conditions: VOID WHERE PROHIBITED BY LAW. The laws of the United States govern this contest. All federal, state and local laws and regulations apply. This contest is not to be used in connection with any form of gambling. The prize winner is responsible for all state and federal income taxes and all other fees and surcharges of whatever kind applicable to his or her prize. Except where legally prohibited, the prize winner grants permission for Ocean Waters Management, LLC and its advertising and promotional agencies, and those acting under the authority of each, the right to use the prize winner’s name and/or likeness in perpetuity for advertising and/or promotional purposes in all media now known or hereafter discovered, worldwide and on the world wide web, without notice, review, approval, or additional compensation. Delivery and use of the prize is subject to the prize winner’s completion of all documentation required by law or otherwise required by Ocean Waters Management, LLC. By entering this contest and/or using any prize, entrant agrees: (1) to release Ocean Waters Management, their respective parents, subsidiaries and affiliates and their respective shareholders, officers, directors, employees, members, agents and assigns from liability of any kind or nature for any loss, claims, damages, or injuries of any kind associated with participation in this contest or with acceptance and use of any prize; (2) to receive phone, email and mail solicitation from Ocean Waters Management, LLC, even if otherwise listed on a do-not-call list or other similar list; and (3) to be bound by these rules and any decisions of Ocean Waters Management, LLC relating to participation in the contest, selection of winners and awarding of prizes, whose decisions are final. Persons who violate any rule, gain unfair advantage in participating in the contest, or obtain winner status using fraudulent means will be disqualified. If the conduct or outcome of the contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of Ocean Waters Management, LLC; Ocean Waters Management, LLC reserves the exclusive right to terminate this contest, or make such other decisions regarding the outcome as it deems appropriate.
